The essay discusses the import of the separability thesis both for legal positivism and for contemporary legal practice. First, the place of the separability thesis in legal positivism will be explored, distinguishing between “standard positivism” and “post-Hartian positivism.” Then I will consider various kinds of relations between law and morality that are worthy of jurisprudential interest, and explore, from a positivist point of view, what kind of relations between law and morality must be rejected, what kind of such relations should be taken into account, and what kind of such relations are indeed of no import at all. In questo saggio si esamina criticamente la tradizione di ricerca del positivsmo giuridico denominata "inclusive positivism", con riferimento soprattutto al pensiero del filosofo del diritto americano Jules Coleman.Viene soprattutto focalizzata criticamente la questione del modo in cui l'inclusive positivism intende il ruolo dei giudizi di valore nell'interpretazione giuridica e nell'attività dogmatica dei giuristi. La tesi che l'autore avanza è che la presenza dei giudizi di valore è necessaria nell'attività di giudici e giuristi e attraversa anche la componente conoscitiva di tale attività.

The controversy between Dworkin and legal positivism has lasted more than forty years. After Dworkin’s death, a reflection on this debate is needed. This paper faces some of the most important and popular arguments Dworkin advanced against legal positivism. More precisely, the article is divided in two main parts. Shapiro works out a version of legal positivism taking as its starting point Hart’s practice theory of law. Some serious limits of Hart’s practice theory of norms concern the conception of legal obligation and normativity of law. In this paper I analyze the limits of Hart’s conception of legal normativity and I appraise whether the planning theory of law indicates the correct direction for overcoming them.
